Changing Your Name After Divorce

I took my husband's name when I married, but now we're getting divorced and I'd like to return to my former name. How do I do that?

In most states, you can request that the judge handling your divorce make a formal order restoring your former or birth name. If your divorce decree contains such an order, that's all the paperwork you'll need. You'll want to get certified copies of the order as proof of the name change -- check with the court clerk for details. Once you have this official documentation, you can use it to have your name changed on your identification and personal records.

How do I get child support out of my bankrupt ex-husband?

QUESTION:

A bankruptcy court just notified me that my ex-husband is filing for Chapter 7. I am one of his creditors, because: a) he owes back child support, including for medical bills, b) he's not paying current child support, and c) when we divorced, he was ordered to pay me $2,700 to equally divide our property. Will he be able to wiggle out of these debts? The court notice said I should speak with a lawyer, but I can't afford one.

Sideways - The Break-Up

Only a couple of weeks after winning an Oscar for his road-trip comedy Sideways, film director Alexander Payne is getting separated from his wife of five years, Canadian actress Sandra Oh. A spokesperson for the couple confirmed the split in a statement released on March 11. "The couple will remain friends," she said, adding that Payne and Oh had "mutually decided to separate," according to People magazine. Payne and Oh, who have been married since 2003, were a couple for five years.

Arizona House OKs New Division of Assets in Divorce Cases

By a 31-20 margin the House gave preliminary approval Monday to legislation letting judges alter how they divide up property in divorces.

Current law requires property to be divided up on an equitable basis. SB 1145 permits a judge to consider "marital misconduct" in making that decision.

The legislation also makes misconduct a factor that may be considered in determining whether one spouse pays alimony to the other and in what amount, and in the payment of child support.

Rep. Russell Pearce, R-Mesa, said misconduct should be a factor. He said it is easier to get out of a 40-year marriage than break a lease.

But Rep. David Bradley, D-Tucson, said this will result only in more acrimonious divorces and more traumatized children. The measure, which already has been approved by the Senate, now needs a final House roll-call vote.

Michael Bonk, 44, says him and his five-year old daughter's transient lifestyle is better than the one they were recently living in Chandler, Arizona, even if it means he's a wanted man.

Bonk was charged with custodial interference, and a warrant was issued for his arrest in March. A judge agreed he violated an order that prohibited either parent from taking "Catie" out of Maricopa County without prior consent.

Bonk said he thought fleeing was the only option left. A February report from Catie's court-appointed representative noted "serious concerns" about his "mental stability, emotional integrity and parental abilities," court records show.

It was "the final straw" in a custody battle that has endured for most of his daughter's life, he said. He had custody but sensed it would end soon.

"(The report said) I wasn't fit enough to be a parent," Bonk said. "I just said, 'This is it. I'm done.' "

He began planning their escape.

Phoenix Arizona - 158 Domestic Violence Cases Tossed

Glendale police have been forced to scrap 158 domestic-violence cases because the detective assigned to the cases falsified reports and failed to file the necessary paperwork, officials say.

As a result, they say, wrongdoers will go unpunished and their victims will never get their day in court. At least one woman said she was victimized several times more.

Under Arizona law, domestic violence includes, among other things, physical injury inflicted between married or unmarried partners either living together or sharing a child with each other. It also can involve the use of a deadly weapon in making threats.

Puffy To Pay Child Support

There has been a legal victory of sorts for P. Diddy.

A New York Court of Appeals has ordered the hip-hop mogul otherwise known as Sean Combs to cough up $21,782 a month in child support to fashion stylist Misa Hylton-Brim, the mother of his 11-year-old son.

The good news is the amount settled on by the state Supreme Court's Appellate Division on Thursday is significantly lower than the $35,000-per-month sum Combs was initially required to pay by Westchester County Family Court Judge David Klein last August.

Can my husband's ex and I share the same last name without problems?

QUESTION:

I am getting married; my first time, his second. I will be taking his name when we marry. Will there be any problems if his ex keeps her married name, too? We don't have the same first name.

ANSWER:

You will probably not incur problems -- after all, there are legions of people who have the same last name; you need only look in the telephone book under Smith to get hard evidence of this.

As long as your new mate's ex mate does not falsely hold herself out as still married to your man, any minor problems that may develop -- for example, your creditors' becoming confused -- should be easy to straighten out with a clear written explanation of who is and is not married to whom.

Santa Cruz County Arizona Child Support Incarceration

He's spent 27 months and counting behind bars at the Santa Cruz County Jail. No end of captivity in sight. This may well be the old man's last address.

Prisoner 44845, Manuel "Manolo" Osete, is a fit, if pale, 72-year-old man who doesn't blend in. He is surrounded by "kids," the drug offenders, the drunken-driving and domestic-violence suspects. Ironically, the kids generally get out after a couple of weeks, either on their own recognizance or on bond.

No one--except Osete--is sentenced here for more than a year. Osete calls the jail home. To date, it has cost the county $55,000 to keep Osete behind bars--and the setting suggests he's a danger to someone.

Conversations with visitors are conducted on the telephone through thick safety glass. Contacts are limited to 15-minute chats on Sunday afternoons. Newspapers and magazines aren't allowed. For his rare appearances in court, he is taken to Tucson in shackles. Time outdoors is limited to about 30 minutes a week, less than what death row inmates generally receive.

So what crime is Osete charged with?

He isn't charged with a crime.

"The other inmates ask me what I'm here for," Osete said. "I tell them, 'Divorce,' and they get a good laugh."

Valley Little League baseball and softball administrators ask for just about everything but the parents' firstborn to prove residency, but they realize they're not immune to the cheating that scarred the local Pop Warner scene last fall.

Pop Warner football playoffs were canceled after the Arizona Youth Football Federation discovered widespread abuse of proof of residency requirements and falsification of applications.

New Mexico Governor Cleans Up Child Support Blunder

SANTA FE -- Gov. Richardson proposes that state child welfare workers be required to sign affidavits saying they've actually seen the children they work with.

He says he wants to make sure no more child support is awarded for kids who don't exist.

Richardson cites a case in which an Albuquerque woman collected money during several years for a child she never had.

Georgia Adopts Arizona-Like Child Support Guidelines

Lawmakers approved sweeping changes Thursday in the way child support payments are calculated in Georgia.

Child support payments are usually based on considering only the income of the parent who does not have custody. House Bill 221 would require judges to consider the incomes of both parents when determining child support awards.
